Terms of Service

By creating an account or using Case Scribe, you agree to these Terms of Service. Please read them carefully. If you do not agree, do not use the platform.

1. About Case Scribe

Case Scribe is an AI-powered workflow platform designed to assist employment service professionals — including Employment Mentors, In Work Mentors, Employer Engagement Specialists, and Team Leaders — with case note generation, participant management, compliance tracking, and related tasks.

Case Scribe is operated by Kenneth Fx (ABN to be inserted), Victoria, Australia ("we", "us", "our").

2. Acceptance of Terms

By registering for an account, clicking "I agree", or using any part of the Case Scribe platform, you accept these Terms of Service and our Privacy Policy. If you are using Case Scribe on behalf of an organisation, you represent that you have the authority to bind that organisation to these terms.

Case Scribe is a productivity and workflow tool. It is NOT a system of record for compliance purposes. WAOP (Workforce Australia Online for Providers) and your organisation's approved systems remain the authoritative record for all IEA compliance obligations. Case Scribe does not replace any mandatory recording, reporting, or compliance requirements under the IEA Deed or Guidelines.

AI-generated content (case notes, coaching plans, policy answers) is provided as a drafting aid only. Users are responsible for reviewing, editing, and ensuring the accuracy of all content before use. Case Scribe does not guarantee that AI-generated content is accurate, complete, or compliant with current guidelines.

7. Subscription and Payment

Pricing

Case Scribe is offered on a per-seat subscription basis. Current pricing is displayed at casescribe.com.au and within the platform. We reserve the right to change pricing with 30 days' notice to existing subscribers.

Billing

Subscriptions are billed monthly in advance. Payment is processed securely via Stripe. By providing payment details, you authorise recurring charges until you cancel.

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused days within a billing period.

Refunds

We offer a full refund within 7 days of your first payment if you are not satisfied with the platform. After 7 days, payments are non-refundable except where required by Australian Consumer Law.

Free trial and beta access

Beta users may be granted free access during the pilot period. We will provide at least 14 days' notice before transitioning beta users to paid subscriptions.

8. Intellectual Property

Case Scribe and all associated software, design, templates, and content are owned by Kenneth Fx and protected by Australian and international intellectual property laws.

You retain ownership of all content you create using Case Scribe, including case notes and participant data. By using the platform, you grant us a limited licence to process your content solely for the purpose of providing the service.

Our IEA-specific compliance logic, template library, and policy knowledge base represent significant proprietary investment and may not be copied, reproduced, or used outside the platform.

Case Scribe uses the Anthropic API (Claude) to generate content. You acknowledge that:

We aim to provide reliable access to Case Scribe but do not guarantee uninterrupted availability. We may perform maintenance, updates, or experience outages beyond our control. We will endeavour to provide advance notice of planned maintenance where possible.

11. Limitation of Liability

To the maximum extent permitted by Australian law, Case Scribe and its operators are not liable for:

Our total liability to you in any circumstances is limited to the amount you paid for the service in the 3 months prior to the claim.

Nothing in these terms excludes liability that cannot be excluded under the Australian Consumer Law, including guarantees relating to services.

12. Termination

We may suspend or terminate your access to Case Scribe immediately if you breach these terms, engage in fraudulent activity, or if we are required to do so by law. Upon termination, you may request an export of your data within 30 days. After 30 days, data will be permanently deleted.

13. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes via email at least 14 days before they take effect. Continued use of the platform after that date constitutes acceptance of the updated terms.

14. Governing Law

These terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
